Terms and Conditions of Use

These terms and conditions (the "Terms") govern your access to and use of Truly Uninhibited websites and mobile applications (the "Site"). By accessing or using the Site, you are agreeing to these Terms and entering into a legally binding contract with Truly Uninhibited. Read them. Understand them. If you're not willing or able to be bound by these Terms, don't use the Site — it's that simple.
Any references to "you" and "your" refer to you, as a user of the Site. References to "we", "us" and "our" refer to Truly Uninhibited.
1. CHANGES TO THESE TERMS
We may modify these Terms at any time. When we do, we'll update the date at the top of this page. All material changes apply going forward only. It's on you to check back regularly — continuing to use the Site after we post changes means you've accepted them. No surprises; just stay informed.
2. USING THE SITE
a) Permission to Use
We grant you a limited, non-exclusive, non-transferable permission to use the Site, subject to these Terms. We can revoke that permission at any time if we determine your conduct is inappropriate or in breach of these Terms. Your use of the Site is entirely at your own risk — including exposure to content that may be offensive, indecent, inaccurate, or otherwise not to your taste.
b) Site Availability
The Site may be modified, updated, interrupted, suspended, or discontinued at any time, for any reason or no reason at all, without notice or liability to Truly Uninhibited. We make no promises about uptime or availability.
c) User Accounts
Some areas of the Site require registration. We reserve the right to reject or require changes to any username, password, or other registration information at our discretion. Your credentials are for your personal use only — keep them confidential. You are responsible for all activity under your account. Notify us immediately of any unauthorized access or breach. We reserve the right to close any account at any time, for any reason, at our sole discretion. We further reserve the right to disclose your identity and information about you in the event of a complaint, legal action, or when necessary to protect the safety and security of others.
3. CONTENT
a) Your Responsibility
You own what you post — and you're fully responsible for it. You agree to indemnify and hold harmless Truly Uninhibited and our agents against any claim arising from your messages or postings. We reserve the right to remove any content, at any time, for any reason or no reason at all.
b) License Grant to Truly Uninhibited
By posting messages, uploading files, submitting data, or communicating through this Site in any way, you grant Truly Uninhibited a royalty-free, perpetual, non-exclusive, unrestricted, fully transferable, worldwide license to: (1) use, copy, sublicense, adapt, transmit, publicly perform, or display that content; and (2) sublicense to third parties the unrestricted right to do any of the foregoing. This includes all proprietary rights in the content, including rights under copyright, trademark, service mark, and patent laws in any jurisdiction.
c) Our Ownership
Everything on the Site — text, data, graphics, logos, icons, images, audio, video, links, downloads, software, and all other materials — is owned by, controlled by, or licensed to Truly Uninhibited and is protected by copyright, trademark, and other intellectual property laws. Site materials are available solely for your personal, non-commercial use. You may not copy, reproduce, modify, republish, upload, post, transmit, or distribute any materials without our express prior written consent. You may download materials intentionally made available for download for your personal, non-commercial use only, provided all copyright and proprietary notices are kept intact.
4. RESTRICTIONS
The following rules govern your use of the Site. We do not review every post or validate the accuracy of information shared. We are not responsible for user-generated content and do not vouch for its accuracy or completeness. Content posted by users does not represent the views of Truly Uninhibited. If you encounter objectionable content, contact us — we'll evaluate and remove it if warranted. Manual moderation takes time, so please be patient.
You agree not to — and will not help, encourage, or enable others to — use the Site to:
a) Post material that is knowingly false, defamatory, inaccurate, abusive, vulgar, obscene, profane, hateful, harassing, sexually oriented, threatening, privacy-invasive, or otherwise in violation of any applicable law;
b) Post or transmit material that infringes a third party's copyright or other intellectual property or proprietary rights;
c) Post or transmit any information or software containing viruses, worms, defects, Trojan horses, or anything else harmful, disruptive, or destructive in nature;
d) Engage in commercial activity (including sales, contests, or sweepstakes) without prior written consent from Truly Uninhibited;
e) Solicit, collect, or request personal information for commercial or unlawful purposes;
f) Solicit personal information from minors;
g) Send bulk emails, surveys, or mass messaging of any kind;
h) Engage in keyword spamming or attempt to manipulate the Site's search results;
i) Impersonate any individual or entity;
j) Restrict or inhibit any other user from using and enjoying the Site (including through hacking or defacement);
k) Use any robot, spider, scraper, or automated device, process, or means to access, retrieve, or index any part of the Site;
l) Remove or modify any copyright, trademark, or proprietary rights notice on any portion of the Site;
m) Record, process, or mine information about other users;
n) Reformat or frame any portion of the Site;
o) Impose an unreasonable or disproportionately large load on our infrastructure or make excessive traffic demands of the Site;
p) Attempt to gain unauthorized access to the Site, user accounts, computer systems, or networks through hacking, password mining, or any other means;
q) Use any device, software, or routine that interferes with the proper working of the Site;
r) Use the Site to violate the security of any computer network, crack passwords or encryption codes, or disrupt or harm the Site in any way; or
s) Remove, circumvent, disable, damage, or otherwise interfere with any security-related features of the Site, including features that prevent or restrict use or copying of content or enforce usage limitations.
5. UNSOLICITED SUBMISSIONS
We don't accept or consider unsolicited sound recordings, musical compositions, or any other creative materials ("Submissions"). If you send us something anyway, know that: (i) we have no obligation to you or anyone claiming through you based on that Submission; and (ii) you waive any claim based on it. Don't send us your demos without an invitation — we mean it.
6. PRIVACY POLICY
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. If something isn't clear, read it. We take your privacy seriously and handle your data with purpose and discretion.
7. THIRD-PARTY SITES
The Site may contain links to third-party websites or applications ("Third Party Sites"). Unless explicitly stated otherwise, Truly Uninhibited does not operate, control, or endorse anything on those Third Party Sites. Your use of any Third Party Site is entirely at your own risk. We are not responsible for the availability or content of any Third Party Site.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Truly Uninhibited and its affiliated companies, officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs — including reasonable attorneys' fees — resulting from: (i) your access to or use of the Site; (ii) your violation of these Terms; (iii) your use of any products or services purchased through the Site; or (iv) infringement of any intellectual property or other right of any person or entity by you or any third party using your account. Truly Uninhibited reserves the right, at your expense, to assume the exclusive defense and control of any such matter.
9. WARRANTY DISCLAIMER AND LIMITATIONS OF LIABILITY
READ THIS SECTION CAREFULLY. IT LIMITS THE LIABILITY OF TRULY UNINHIBITED, ITS SUBSIDIARIES, AFFILIATES, AND LICENSORS. THESE PROVISIONS APPLY TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW. NOTHING HEREIN IS INTENDED TO LIMIT ANY RIGHTS YOU MAY HAVE WHICH CANNOT BE LAWFULLY LIMITED.
THE SITE IS MADE AVAILABLE ON AN "AS IS", "WITH ALL FAULTS", AND "AS AVAILABLE" BASIS. YOUR USE OF THE SITE IS AT YOUR SOLE DISCRETION AND RISK. TRULY UNINHIBITED MAKES NO CLAIMS OR PROMISES ABOUT THE QUALITY, ACCURACY, RELIABILITY, SAFETY, OR SECURITY OF THE SITE OR ITS CONTENT. ACCORDINGLY, TRULY UNINHIBITED IS NOT LIABLE TO YOU FOR ANY LOSS OR DAMAGE ARISING FROM YOUR USE OF THE SITE.
a) TRULY UNINHIBITED EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SITE.
b) TRULY UNINHIBITED, ITS AFFILIATES, AND SPONSORS ARE NOT RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES ARISING OUT OF OR RELATING IN ANY WAY TO THE SITE OR ANY THIRD PARTY SITE. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE, RELATED SERVICES, OR ANY THIRD PARTY SITE IS TO STOP USING IT.
c) TRULY UNINHIBITED DOES NOT WARRANT THAT THE FUNCTIONS ON THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
d) TRULY UNINHIBITED DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR RESULTS OF ANY MATERIALS ON THE SITE OR ANY THIRD PARTY SITE.
e) TRULY UNINHIBITED MAKES NO REPRESENTATIONS REGARDING HOW OFTEN MATERIALS OR INFORMATION WILL BE UPDATED, OR WHICH ARTISTS OR INDIVIDUALS (IF ANY) WILL BE FEATURED ON THE SITE.
10. GEOGRAPHIC LIMITATIONS
While this Site is accessible worldwide, not all products or services referenced on it are available everywhere. Truly Uninhibited reserves the right to limit, in its sole discretion, the provision and quantity of any product or service to any person or geographic area. Any offer made on this Site is void where prohibited.
11. MAKING PURCHASES
If you wish to purchase products or services through the Site, you may be required to provide payment and other information. By initiating a transaction, you represent and warrant that you: (A) are at least eighteen (18) years of age; and (B) have the legal right to use your selected payment method. You agree to provide accurate, complete, and current information and to pay all charges — including applicable taxes and shipping and handling fees — at the prices in effect at the time of your transaction. Truly Uninhibited reserves the right to change pricing and availability at any time without prior notice.
12. RETURNS & REFUNDS
All sales are subject to our Returns & Refunds Policy, which is incorporated into these Terms by reference and available on the Site. By making a purchase, you agree to be bound by that policy. We reserve the right to update the Returns & Refunds Policy at any time. Truly Uninhibited is not obligated to accept returns or issue refunds except as required by applicable law or as stated in our published Returns & Refunds Policy.
13. PROMOTIONS
Any contests, sweepstakes, surveys, games, or similar promotions ("Promotions") made available through the Site may be governed by specific rules separate from these Terms. Participating in a Promotion means you're also subject to those rules, which may differ from these Terms. Read them carefully. Where Promotion rules conflict with these Terms, the Promotion rules control.
14. DISPUTE RESOLUTION & ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or your use of the Site — including the determination of the scope or applicability of this arbitration provision — shall be resolved by final and binding arbitration rather than in court. The arbitration shall be conducted on a confidential basis under the rules of the American Arbitration Association ("AAA"), or a mutually agreed-upon arbitration body. You agree that any arbitration will be conducted on an individual basis and not as a class action. You waive any right to participate in any class action or class-wide arbitration.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
15. GOVERNING LAW & JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of the State of CA, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in United States, Santa Clarita, CA, and you consent to personal jurisdiction and venue in those courts.

16. FORCE MAJEURE
Truly Uninhibited shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government actions, labor disputes, natural disasters, pandemics, internet outages, or failures of third-party service providers. In such events, we will make reasonable efforts to resume normal operations as soon as practicable.
17. GENERAL PROVISIONS
a) Severability. If any provision of these Terms is held to be unenforceable by a court or tribunal of competent jurisdiction, that provision shall be modified to the minimum extent necessary so that the remaining Terms stay in full force and effect.
b) Entire Agreement. These Terms constitute the entire agreement between you and Truly Uninhibited regarding your use of the Site and supersede all prior agreements on the subject matter. Neither party relies on any representation not expressly contained herein.
c) Notices. We may provide you with notices — including changes to the Terms — by email, regular mail, or communications through the Site.
d) No Waiver. Any failure by Truly Uninhibited to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
e) Non-Assignability. These Terms are not assignable, transferable, or sublicensable by you without our prior written consent. We may assign or transfer these Terms at any time without restriction. Any unauthorized assignment is void.
MOBILE TERMS OF SERVICE

The Truly Uninhibited mobile message service (the "Service") is operated by Truly Uninhibited ("we", "us", or "our"). Your use of the Service means you agree to these Mobile Terms. We may modify or cancel the Service or any of its features at any time without notice. To the extent permitted by law, we may also modify these Mobile Terms at any time — continued use of the Service after any change takes effect constitutes your acceptance.
By opting into Truly Uninhibited's SMS/text messaging service, you agree to receive recurring SMS/text messages from or on behalf of Truly Uninhibited through your wireless provider to the mobile number you provided — even if your number is on a state or federal Do Not Call list. Messages may be sent using an automatic telephone dialing system or other technology. Service messages may include updates, alerts, and information (e.g., order updates, account alerts). Promotional messages may include offers, deals, and other marketing content (e.g., cart reminders).
You do not have to opt in to make purchases on the Site. Your consent to receive SMS messages is not a condition of any purchase. Participation is voluntary.
We don't charge for the Service, but your wireless provider may charge message and data rates. Message frequency varies. Check your mobile plan for details. You are solely responsible for all charges related to SMS/text messages.
You may opt out at any time. Text STOP to us or click the unsubscribe link in any message to cancel. You'll receive a one-time confirmation. No further messages will be sent unless initiated by you. If you've subscribed to multiple Truly Uninhibited mobile programs, you'll need to opt out from each separately.

We may change any short code or telephone number used to operate the Service at any time and will notify you. Messages (including STOP or HELP requests) sent to changed numbers may not be received, and we are not responsible for honoring requests made to outdated numbers.
Wireless carriers are not liable for delayed or undelivered messages. You agree to provide a valid mobile number. If your number changes, you'll need to sign up again with your new number.
To the extent permitted by applicable law, Truly Uninhibited is not liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, or any action you take or don't take based on the Service.
